RE: Upcoming Zoning Code Revision
Please enter the following into the record as a Communication:
Both the "New" Zoning Code and the "Old" Zoning Code list "non- significant
zoning changes" which can be granted administratively.
Since it is possible to define non - significant zoning changes, it should also be
possible to define "major" zoning changes requiring an HRS 343 Environmental
Impact Statement.
I would suggest that those changes would consist of proposals meeting any one of
the following criteria:
1. A proposal which involves more than fifteen acres.
2. A proposal in which infrastructure and other development costs come to more
than one - million dollars.
3. A proposal which involves the construction of more than five dwelling units.
There is nothing hard and fast about those criteria. They are meant to be only
suggestions. The important element is to require an HRS 343 Environmental
Impact Statement for ay major development. Without that requirement, an urban
development in North Kohala (Project IV at Kohala Ranch) was approved by the
County without the need for an HRS 343 EIS, even though it more than doubled
the population and dwelling unit size of the entire district of North Kohala. Surely,
that was a major development, and yet neither it, nor even larger developments
require the filing of an HRS 343 under either the old or the new code.
The State Office of Environment and Quality Control has already said that it would
be happy to apply all the existing rules to any EIS requirement submitted to it by
the County, so such a provision would entail no additional costs to the County.
I respectfully urge the Council to seriously consider modifying the Zoning Code
under consideration to include the above provision. arahm. N0. •
