NIahalo. Aloha, Nis. Leithead -Todd: Your suggestion that the Zoning Code be revised in a `fasttrack" process has come to my attention. I see red flags all over the place in light of this suggestion. Thanks to members of the community for bringing it to light, the courts have detemined that the 7oning Code that was accepted by the now- defunct council is in violation of State law. The latest revised code offers no protection - -in fact, restri public participation - -to democratic per, while it further opens county resources to the haphazard. poorly thought -out development which continues to plague this counts. Some of the points in the latest Zoning Code with which I am in total disagreement are those that - -like making important decisions without community input —give undo powers of decision - making to an appointed body (the Planning Commission): allowing excessive height limits for agricultural structures on .agricultural land and determining height limits for buildings and communications: alloying small hotels on .-\g or Open land with only a Use Permit: establishment of shoreline setbacks. I also strongly object to eliminating EIS requirements and, in fact. feel that there is a crucial need to consider addition of CIS (Cultural Impact Statements) in mans cases. Eliminating contested case hearings when Use Permits are considered is in clear opposition to the inclusion of the pubic in democratic processes (Contested Case hearings should not be deemed unnecessary bits of "red tape. ") I strongly request that the Zoning -)de be thoroughly examined by the new council iii a manner that alloys time for this important activity to take place. Thirty -three days is isufficient. Rather, several months would alloy the proper time for this York to occur - -work which gill affect all communities on Hawaii Island.
