AN ORDINANCE AMENDING CHAPTER 24, ARTICLE 11, DIVISION 1, SECTION 24- 300 OF THE HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO SPEED LIMITS ON PRIVATE STREETS. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. The purpose of this ordinance is to establish speed limits in the Fern Acres subdivision so that speed limits can be properly enforced by the police. Pursuant to Section 24-2 of the Hawaii County Code, the County shall not be responsible for the maintenance and repair of any private street, highway, or thoroughfare when it imposes or enforces traffic regulations and highway safety laws on that private street, highway, or thoroughfare. SECTION 2. Chapter 24, article 11, division 1, section 24-300, schedule 4. 25 mile per hour limit, subsection(g) of the Hawaii County Code 1983 (2005 Edition, as amended), is amended to read as follows: "(g) Puna (1) Ainaloa Subdivision. 1. Ainaloa Drive, from Ainaloa Way to Stardust Drive. (2) Mauna Loa Estates Subdivision. 1. All streets. (3) Nanawale Estates Subdivision. 1. Flower Road. 2. Forest Road. 3. Hapu`u Road, from Forest Road to Nanawale Boulevard. 4. Kapuna Road. 5. Kehau Road, from Forest Road to Nanawale Boulevard. 6. Mauna Ke`a Road. 7. Seaview Road. (4) Hawaiian Paradise Park Subdivision, all paved roads except for Shower Drive, Kaloli Drive, Paradise Drive, and Maku`u Drive. (5j Fern Acres Subdivision. 1. Puhala Street. 2. Plumeria Street. 3. Lehua Street. 4. Hibiscus Street. 5. Pikake Street." SECTION 3. New material is underscored. In printing this ordinance, the underscoring need not be included. SECTION 4. Severability. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable. SECTION 5. This ordinance shall take effect upon its approval.
