re Zoning Code changes
Dear Vs Leithead -Todd and Committee Members
Draft 4 of the new zoning code raises nrimerous Tiestions that need to be addressed including the
following
I Why should there nor be a public hearing imalr tug permits or special permits for golf courses and
golf clubhouses in agricultural Districts' should the Planning Commission be allowed to place
commercial theme parks amusement parks and al Ito race tracks in Agricultural Districts'
We must protect the precious agricultural lands w e do have Dev eloping these lands should La dune
only with public input some lands need to he pr ntecred from am' use except agriculture
2 \ \'h should the Planning Department be able to specify a setback of less than 40 feet along the
shore line' With the island sinking and melting icecaps causing the ocean to rise. setbacks should tin
greater than 40 feet particularly for mule -stns\ Pnnldings that cull last 50 to 100 years
the 20 foot minimum state setback was decided 20 or 30 ears ago, before the University of Hawaii
studies showed that major beach erosion is due to locating stnictures and protecting IA ails Inc close in
the shore line
3 Why does the new code not allow the C nuns Council to set conditions regarding historic sires
environmental concerns when setting rondinons for zoning'
To eliminate the County Council from haying an impact in these two areas would tie the hands nt 011
elected represents rn es from a critical clot\
4 \\'hy eliminate the need for public bitilrltngs 10 he hu tit only in areas that conform to the General
Plan'
This would eftectnely negate an important porrton nt the General Plan Builders could then get at -TT; rn
the General Plan frustrating the public who - Inc eloped the Plan and the County Council he arlopted
the Platt
5 Why should the newly designated "hoar. ru Dist n et" he allowed within agric:ultur al land'
A Protect District allows a nix of tesutt tesiclenmal and commercial uses. this is totally utconsistei
with presen'irrg agricultural land
If we understand die changes referenced aho\r the zoning code should not be appt in it s preven
for in but t ad ter amended and tnodi bed to c ort ec t ilt ese fundamental pi oblen is
Sincerely yours,
