RESOLUTION NO. 423 14
A RESOLUTION AUTHORIZING THE DIRECTOR OF FINANCE TO ENTER INTO
NEGOTIATIONS FOR THE ACQUISITION OF TAX MAP KEY NOS. (3) 7-7-008:021
AND 023, WHITE SANDS MAUKA IN THE AHUPUA`A OF PAHOEHOE IN THE
DISTRICT OF NORTH KONA, PURSUANT TO CHAPTER 2, ARTICLE 42 OF THE
HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED).
WHEREAS, Chapter 2, Article 42 of the Hawaii County Code 1983 (2005 Edition, as
amended) (hereinafter "the Code"), established the Public Access, Open Space, and Natural
Resources Preservation Fund; and
WHEREAS, Section 2-215 of the Code established the Public Access, Open Space, and
Natural Resources Preservation Commission (hereinafter"the Commission"); and
WHEREAS, Section 2-217 of the Code provides, in pertinent part, that the
Commission's first duty and responsibility is, "To develop and submit to the mayor, an initial
island-wide prioritized list of qualifying lands worthy of preservation..."; and
WHEREAS, the Commission cited the purchase of White Sands Mauka as a key priority
and ranked it number ten in its 2013 Annual Report to the Mayor, dated December 27, 2013; and
WHEREAS, White Sands Mauka, covered by Tax Map Key Nos. (3) 7-7-008:021 and
023, offers a unique opportunity for public outdoor recreation and education, serving what
continues to be one of the most densely populated areas on Hawaii Island; and
WHEREAS, the acquisition of this property will expand Kipapa Park, which was
recently acquired by the County of Hawaii, turning it into a combined 16.8-acre recreation area
suitable for walking, biking,jogging, picnicking, and parking; and
WHEREAS, the property, which is zoned RM-3.5, has been approved for a 120-unit
condominium and runs from Ali`i Drive to the proposed Ali`i Parkway right-of-way; and
WHEREAS, a County-required Special Management Area Use Permit and an
archaeological survey conducted by Haun & Associates in 2005 clearly identified and
documented significant burial and cultural sites; and
WHEREAS, Chapter 6, Section 6.3(d) of the Hawaii County General Plan (February
2005 Edition, as amended) states, "Public access to significant historic sites and objects shall be
acquired, where appropriate."; and
WHEREAS, the acquisition of this property would provide a buffer between
development and these areas which could be explored for educational and cultural preservation
purposes; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that
the Director of Finance is authorized to enter into negotiations for the acquisition of White Sands
Mauka in the Ahupua'a of Pahoehoe in the district of North Kona, pursuant to the terms of this
resolution.
BE IT FURTHER RESOLVED that the Director of Finance is hereby authorized to
initiate any funding mechanisms required for the acquisition of White Sands Mauka in
accordance with Chapter 2, Article 42 of the Hawai`i County Code.
BE IT FINALLY RESOLVED that the County Clerk shall forward a copy of this
resolution to the Honorable Mayor William P. Kenoi, the Director of Finance, the Director of
Parks and Recreation, and the Hawai`i County Public Access, Open Space, and Natural
Resources Preservation Commission.
