COUNTY OF HAWAII ' '!'• STATE OF HAWAII <br /> RESOLUTION NO. 456 14 <br /> RESOLUTION AUTHORIZING THE GRANT OF EASEMENT FOR SEWER LINE <br /> PURPOSES AT POUPOUWELA AND KAWALA, DISTRICT OF KA`U, ISLAND OF <br /> HAWAII, HAWAII BEING A PORTION OF LOT 174 OF THE NA'ALEHU <br /> SUBDIVISION, THIRD SERIES TAX MAP KEY: (3) 9-5-024:010 TO THE COUNTY OF <br /> HAWAII. <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII. <br /> WHEREAS, Tina M. Edmunds, is the owner of real property situate at Poupouwela and <br /> Kawala, District of Ka`u, Island of Hawai`i, Hawai`i, being a portion of Lot 174 of the Na`alehu <br /> Subdivision, Third Series identified as Tax Map Key: (3) 9-5-024:010; and <br /> WHEREAS, a federal mandate requires that the County of Hawai`i close the existing <br /> County-owned large capacity cesspool currently serving the Na`alehu community; and <br /> WHEREAS, the County of Hawai`i, Department of Environmental Management is <br /> proceeding with the Na`alehu Collection System Project to replace the current existing sewer <br /> system with a new wastewater treatment plant which includes new collection lines for the <br /> treatment and disposal of sewage; and <br /> WHEREAS, Tina M. Edmunds agrees to grant an easement, on a portion of Lot 174 at <br /> no cost to the County of Hawai`i, Easement S-1, containing an area of 1,614 square feet, more or <br /> less, as described in Exhibit A and delineated on Exhibit B attached hereto, that authorizes, <br /> allows and permits the County of Hawai`i to construct, utilize and maintain the installed sewer <br /> line on their property, for public purpose; <br /> WHEREAS, Article XIII, Section 13-12 of the Hawai`i County Charter provides that the <br /> Council, on behalf of the County of Hawai`i, may accept gifts or donations of real property; now, <br /> therefore, <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, that in <br /> accordance with Article XIII, Section 13-12 of the Hawai`i County Charter, the County of <br /> 1 <br />
