HomeMy WebLinkAboutRES 460 Draft 01 2012-2014 ..... „. ?!V OFN •I� COUNTY OF HAWAII f •i.6' /l' -•- STATE OF HAWAII TF .!----- RESOLUTION NO. 460 14 RESOLUTION ACCEPTING THE BILL OF SALE FOR ROAWAY AND OTHER IMPROVEMENTS FOR"WAIAKEA HOUSE LOTS, 1sT SERIES," AT WAIAKEA, DISTRICT OF SOUTH HILO,ISLAND AND COUNTY OF HAWAII FROM GHC FAMILY LIMITED PARTNERSHIP, A HAWAII LIMITED PARTNERSHIP. BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII. WHEREAS, GHC FAMILY LIMITED PARTNERSHIP, a Hawaii Limited Partnership ("GHC") is the owner of a half-section of the roadway improvements on the east side of Manono Street consisting of a 21-foot wide A.C. pavement with concrete curb, gutter, and sidewalk, drainage improvements, and other improvements as required and approved by the Department of Public Works, within the future road widening setback area established as one- half the distance between the existing right-of-way and 60 feet; and WHEREAS, GHC is the owner of a half-section of the roadway improvements on the west side of Hinano Street consisting of a 16-foot wide A.C. pavement with concrete curb, gutter, and sidewalk, drainage improvements, and other improvements, as required and approved by the Department of Public Works, in the area established as one-half the distance between the existing right-of-way and 50 feet situate at Waiakea House Lots, First Series, Waiakea, District of South Hilo, Island and County of Hawai`i, as delineated on Exhibit"A" attached hereto; and WHEREAS, Condition D of Ordinance No. 09-60, as part of the rezoning conditions of the Manono Street Marketplace Development Project, Waiakea House Lots, First Series, Waiakea, District of South Hilo, Island and County of Hawai`i, requires the granting the County of Hawaii the above-referenced improvements, which are found on the premises described in Exhibit A and GHC is desirous of of granting the same; and WHEREAS, the above-referenced improvements have been inspected and found to be in acceptable condition and are in compliance with the provisions of Chapter 23 of the Hawai`i County Code; and WHEREAS, the County of Hawaii Department of Public Works, Department of Water Supply, Planning Department and Department of Environmental Management have no objection to the acceptance of these improvements; and WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter, provides that the council may accept gifts, or donations of money, securities or other personal property or of real estate or any interest in real estate. BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that it finds the subject subdivision and any improvements thereon are in full compliance with the provisions of Chapter 23 of the Hawaii County Code as certified and approved by all applicable agencies. BE IT FURTHER RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in accordance with Article XIII, Section 13-12 of the Hawaii County Charter, and Chapter 23 of the Hawai`i County Code, that the County of Hawai`i finds that it is in the public interest to accept, and hereby accepts, the Bill of Sale for the improvements found on the premises described in Exhibit A attached hereto. BE IT FINALLY RESOLVED that a copy of this resolution be forwarded to: (1) Mayor William P. Kenoi; (2) the Department of Public Works; (3) Assistant Corporation 2 Counsel Katherine A. Garson; and (4) Alan M. Okamoto, Attorney at Law, Nakamoto, Okamoto & Yamamoto, 187 Kapiolani Street, Hilo, Hawai`i 96720. Dated at Kona , Hawai`i, this 18th day of July , 2014.
