RE: Reaction to Bill 250 (Draft 9)
Dear Chair Arakakai and Members of the Hawaii County Council:
The Board of Directors of the Leleiwi Community Association have reviewed Draft 9 of
Bill 250 and hereby convey their concerns and thoughts For the most part we have
confined our thoughts to those sections that affect our community
pane 7 - - -(31) County environmental report
What exactly does a county environmental report accomplish when the person(s) who
write the report, evaluate that report and make decisions based on their own
conclusions'? Is this report a means of circumventing an environmental impact
statement?
page 29 - - -- Division 4 Amendments
There is an increase on process in this section which increases the work for staff as
well as the applicant. Increased deadlines and notices may be many but we generally
support this section.
page 33 -- Section 25 -2-44 Conditions on channe of zone
A condition that we would like to see the council include is that of environmental
quality, including esthetic quality as a condition in a channe of zone Our open spares
and vistas are what makes our island so attractive to not only residents hut visitors

page 36 - -- Section 25 -2-55 Review of Director's Action
In (c) Notice and Hearing the sentence that has heen added states "A contested case
hearing as defined in chapter 91, Hawaii Revised Statutes, shall not he held by the
commission on any variance application" we strongly object to the inclusion of this
statement for we feel that it impinges on the democratic process to which we are
ontitIorl
page 41 - -- Section 25 -7 -53
We strongly object to the inclusion of the last sentence in (c) (a) which reads "A
contested case, as defined in chapter 91, Hawaii Revised Statues, shall not he held by
the commission for any use permit application " We feel this is again an example of
taking away more power from the interested pu hlic and should not he included
page 56 - -- Section 25 -42 Shoreline setback line regulations
page 56 We question and object to the deletion of Section 74 -42 on shoreline
setback regulations_ The answer riven at the last hearing was that it was redundant
and already covered in state regulations We strongly believe that this section should
not he taken out even if it is redundant Our shorelines are tog precious to let down any
and all safeguards that are in place
page 87 -- Article 5 Toning District Regulations
In section 25 -5 -3 on permitted uses, we feel that RS should stand for exactly what it is,
single family. Any permitted use, if allowed at all should have concurence of the
neighbors and follow the public hearing process Categories we feel that should not he
permitted at all in a residential one are crematoriums, major outdoor amusement and
recreational facilities, and telecommunication antennas and towers_
pane 84 -- Section 25 -5 -8 Other regulations
We question the inclusion of both a guest house and an nhana dwelling as additinns
to this section and the removal of the off - street parkin° requirement. Either nhana or
sliest house should he in the regulation, but not both We feel this will add
tremendously to additional traffic and parkin° proh!ems in a residential zone
We object to the inclusion of item (e) Exceptions to the regulations for RS districts
regarding heights, building site areas, hujlding site average widths and yards, may he
approved by the director within a planned unit development cluster plan development
This again is an example foi Ind thn ghni it the don iment at the end of many sections
that grants the director the Derogative to approve exceptions-

In closing we urge the council to take sufficient time in enacting an ordnance to amend
