RESOLUTION AUTHORIZING THE GRANT OF EASEMENT FOR SEWER LINE
PURPOSES AT POUPOUWELA AND KAWALA, KA`U, ISLAND OF HAWAII,
HAWAII BEING A PORTION OF LOT 175 OF THE NA`ALEHU SUBDIVISION,
THIRD SERIES TAX MAP KEY: (3) 9 -5- 024:009 TO THE COUNTY OF HAWAII.
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII.
WHEREAS, Dale Ann Andrade and Merle Chun, are the owners of real property situate
at Poupouwela and Kawala, Ka`u, Island of Hawaii, Hawaii, being a portion of Lot 175 of the
Nd'dlehu Subdivision, Third Series identified as Tax Map Key: (3) 9 -5- 024:009; and
WHEREAS, a federal mandate requires that the County of Hawaii close the existing
County -owned large capacity cesspool currently serving the Nd'dlehu community; and
WHEREAS, the County of Hawaii, Department of Environmental Management is
proceeding with the Nd'dlehu Collection System Project to replace the current existing sewer
system with a new wastewater treatment plant which includes new collection lines for the
treatment and disposal of sewage; and
WHEREAS, Dale Ann Andrade and Merle Chun agree to grant an easement, on a
portion of Lot 175 at no cost to the County of Hawaii, Easement S -2, containing an area of
1,008 square feet, more or less, as described in Exhibit A and delineated on Exhibit B attached
hereto, that authorizes, allows and permits the County of Hawaii to construct, utilize and
maintain the installed sewer line on their property, for public purpose;
WHEREAS, Article XIII, Section 13 -12 of the Hawaii County Charter provides that the
Council, on behalf of the County of Hawaii, may accept gifts or donations of real property; now,
therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, that in
accordance with Article XIII, Section 13 -12 of the Hawaii County Charter, the County of
Hawaii accepts the grant of easement delineated on Exhibit B attached hereto, from Mildred
Andrade.
BE IT FURTHER RESOLVED that a letter of appreciation and a copy of this
resolution be sent to Dale Ann Andrade and Merle Chun, 5031 N. 34th Street, Phoenix,
AZ 85018, acknowledging this generous donation.
BE IT FINALLY RESOLVED that the Clerk of the County of Hawaii is
directed to transmit copies of this resolution to: (1) Mayor William Kenoi; (2) the
Department of Environmental Management; and (3) Senior Deputy Corporation Counsel
Joseph K. Kamelamela.

FOR SEWER PURPOSES
LAND SITUATED AT POUPOUWELA AND KAWALA, KAU,
ISLAND OF HAWAII, HAWAII.
Being a portion of R. P. 7326, L. C. Aw. 7314 to Ku.
Being also a portion of Lot 175, Naalehu Subdivision, Third Series.
Beginning at the southwest corner of this easement, being also the southwest corner of
Lot 175, the coordinates of said point of beginning referred to Government Survey Triangulation
Station "STEIN 2 ", being 464.98 feet North and 2,244,79 feet West, thence running by azimuths
measured clockwise from true South:
1. 168" 44' 30" 15,05 feet along the remainder of R. P. 7326, L. C. Aw.
7314 to Ku (Lot 174);
2. 2530 53' 30" 66.58 feet along the remainder of R. P. 7326, L. C. Aw.
7314 to Ku (remainder of Lot 175);
3. 3430 53' 30" 15.00 feet along same;
4. 73° 53' 30" 67.86 feet along the remainder of R. P. 7326, L. C. Aw.
7314 to Ku (Lots 170 -D and 170 -C) to the
point of beginning and containing an area of
1,008 Square Feet.
