Dear Chairman • rakaki:
The under igned representatives of Ka Pa'akai 0 Ka 'Aina hereby
submit the following testimony regarding the rezoning measure for
Ka'upulehu Developments.
Ka Pa'aka 0 Ka `Aina appealed to the Supreme Court the Land Use
Commission's r classification of 1,000+ acres at Ka'upulehu, District of
North Kona on t e petition of Ka'upulehu Developments. The decision of
the Supreme Co rt is still pending.
Thereafte , in order to adquately preserve our rights previously
established in th LUC proceedings, Ka Pa'akai 0 Ka `Aina also intervened
in the County of Hawaii Planning Commission's SMA proceeding on the
application of K 'upulehu Developments. Following a contested case
hearing the Platming Commission granted the SMA permit on December
11, 1998.
The matte is now before this body for a zoning measure. In that
regard Ka Pa'akai 0 Ka 'Aina directs this council to the Decision rendered
on December 21, 1998 in Civil No. 97.028K, Third Circuit Court Regarding
"Sunshine Law" Violations. The Circuit Court decision renders all actions

taken by the county council since Draft 4, Bill 250 "voidable." To move
ahead on any zcning measure at this time would violate the court's
enforcement order and would only invite further litigation.
In light of t e above, we respectfully urge this council to defer any
action on the zoning measure before the county council for Ka'upulehu
Developments.
