HomeMy WebLinkAboutREP PC 073 2014/07/17 (2012-2014) REPORT OF THE COMMITTEE ON PLANNING REGARDING: Communication No. 939/Bill No. 267 DATE: July 17, 2014 LOCATION: Council Chambers, Kona, Hawai`i TITLE: AN ORDINANCE AMENDING THE STATE LAND USE BOUNDARIES MAPS FOR THE COUNTY OF HAWAII BY CHANGING THE DISTRICT CLASSIFICATION FROM THE AGRICULTURAL TO THE URBAN DISTRICT AT KAMA`OA, KA`U, HAWAII (TMK: 9-2-093:039, 040, 041 & 042). EXPLANATION: Bill No. 267 had been transmitted by Mayor William P. Kenoi, via Communication No. 939, dated June 18, 2014. The area covers 4.143 acres. The applicant is Dr. William C. Foulk. There were testifiers present in Kona(1), Hilo (1), and Ka`u (7) in support of Bill. The developer was also present to provide comment and answer questions by Committee Members. Committee members expressed a desperate need for a commercial center in the area affected. Committee members also expressed concerns regarding the usage of a private road and the process of setting up a proper water system. The developer responded that Lehua Court will gladly contribute funds to get private road up to County standards. He understands there is a possibility that even if the road is up to County standards, the County may not accept dedication. Council Member Ford sought clarity with Corporation Counsel regarding this concern. According to Corporation Counsel, it is ultimately at the Council's discretion as it would need to be voted on at Council level. In regards to the water system concerns, according to the developer, the Dept. of Water Supply remains autonomous and has not agreed to do a commercial meter for the development proposed. The developer expressed appreciation in advance to Committee Members should they choose to advocate in support of a commercial meter, but does not expect such agreement to be made. Although discussion occurred for postponement on item, the motion to postpone was not passed. RECOMMENDATION: Positive; passage of Bill No. 267 at first reading.
