TITLE: AN ORDINANCE AMENDING SECTION 25-8-28 (KA`U
DISTRICT ZONE MAP), ARTICLE 8, CHAPTER 25 (ZONING
CODE) OF THE HAWAII COUNTY CODE 1983 (2005
EDITION), BY CHANGING THE DISTRICT
CLASSIFICATION FROM AGRICULTURAL —ONE ACRE (A-
1 a) TO VILLAGE COMMERCIAL—40,000 SQUARE FEET
(CV-40) AT KAHUKU, KA`U, HAWAII, COVERED BY TAX
MAP KEY 9-2-093:039, 040, 041 & 042.
EXPLANATION: Bill No. 268 had been transmitted by Mayor William P. Kenoi, via
Communication No. 939, dated June 18, 2014. The area covers
4.143 acres. The applicant is Dr. William C. Foulk.
The Windward Planning Commission forwards its favorable
recommendation for the applicant's request for this amendment to
the State Land Use Boundaries Map and change of zone, which
would allow the applicant to develop a 54,000-square-foot
commercial center with an additional 12,500 feet of open
landscaped area to be used for periodic craft fairs, thespian events,
and public gatherings.
There were testifiers present in Kona(1), Hilo (1), and Ka`u (7) in
support of Bill. The developer was also present to provide
comment and answer questions by Committee Members.
There was no discussion by Committee Members due to the
discussion held for Bill No. 267, please refer to PC Report No. 73.
RECOMMENDATION: Positive; passage of Bill No. 268 at first reading.
