RESOLUTION NO. 4'78 14
RESOLUTION ACCEPTING THE DEDICATION OF A PORTION OF KUMAKUA STREET,
NE`EPAPA STREET, HO`OKO STREET, A PORTION OF POMAIKA`I STREET AND
DRAINAGE EASEMENT D, OF KUMAKUA AFFORDABLE HOUSING SUBDIVISION,
PHASE II, BEING TAX MAP KEYS: (3) 5-5-019:025 (POR.) AND (3) 5-5-019:047, SITUATED
AT PAHOA, DISTRICT OF NORTH KOHALA, COUNTY AND STATE OF HAWAII FROM
HAWAII ISLAND COMMUNITY DEVELOPMENT CORPORATION.
WHEREAS, Hawai`i Island Community Development Corporation is the owner of
Kumakua Street (por.) 0.05 mile
Ne`epapa Street 0.06 mile
Ho`oko Street 0.14 mile
Pomaika`i Street (por.) 0.05 mile
along with drainage Easement D, identified as Tax Map Keys: (3) 5-5-019:025(por.) and (3) 5-5-
019:047, situated at Pahoa, in the District of North Kohala, County and State of Hawai`i, as delineated
on Exhibits "A" and "B" attached hereto; and
WHEREAS, Hawai`i Island Community Development Corporation has constructed all
subdivision improvements and received final subdivision approval; and
WHEREAS, Hawai`i Island Community Development Corporation is desirous of dedicating
the above roadways, including all subdivision improvements thereon, to the County of Hawai`i for
road and drainage purposes, and the improvements have been inspected and approved by the County
of Hawai`i Department of Public Works, and received dedication approval from the Department of
Water Supply, Planning Department and Department of Environmental Management; and

WHEREAS, the subject roads and drainage improvements have been completed according to
County of Hawai`i standards, and are in acceptable condition for dedication and in full compliance
with the provisions of Chapter 23 of the Hawai`i County Code; and
WHEREAS, Section 23-10 of the Hawai`i County Code prohibits the Council from receiving
by dedication any streets in any subdivision platted after December 2, 1966 except upon full
compliance with the provisions of Chapter 23; and
WHEREAS, Article XIII, Section 13-12 of the Hawai`i County Charter, provides that the
council may accept gifts, which include the dedication of land, on behalf of the County of Hawai`i;
now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that it finds
the subject subdivision and any improvements thereon are in full compliance with the provisions of
Chapter 23 of the Hawai`i County Code as certified and approved by all applicable agencies.
BE IT FURTHER RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII,
in accordance with Article XIII, Section 13-12 of the Hawai`i County Charter, and Chapter 23 of the
Hawai`i County Code, that the County of Hawai`i accepts the dedication of:
Kumakua Street (por.) 0.05 mile
Ne`epapa Street 0.06 mile
Ho`oko Street 0.14 mile
Pomaika`i Street (por.) 0.05 mile
along with drainage Easement D, Tax Map Keys: (3) 5-5-019:025 (por.) and (3) 5-5-019:047,
delineated on Exhibits "A" and "B" attached hereto, for public road purposes.

BE IT FINALLY RESOLVED that a copy of this resolution be forwarded to: (1) Mayor
William P. Kenoi; (2) the Department of Public Works; (3) Deputy Corporation Counsel Katherine A.
Garson; and (4) Alan Okamoto, Attorney at Law, Nakamoto, Okamoto & Yamamoto, 187 Kapiolani
Street, Hilo, Hawai`i 96720.
