Chairman and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Finance, to which was referred Communication No . 3982, reports as follows : The purpose of Communication No . 3982, from Liquor Commission Director Janice Bibb, is to request the approval of the amendments to the Rules and Regulations of the Liquor Commission of the County of Hawaii regarding the change in the liquor license fee structure. Section 281-17 . 5, Hawaii Revised Statutes , as amended, states as follows : (a) that any liquor license fee shall only be used for actual cost and expense of the Department of Liquor Control in its control, supervision, or regulation of the manufacture, importation and sale of liquor; (b) that any change in the liquor license fee structure adopted by the Liquor Commission requires the approval of the county' s legislative body and mayor; (c) that the Liquor Commission shall notify all licensees affected by the liquor license fee structure change and shall notify each licensee of the outcome and resolution of the change; and (d) that any Liquor Commission which receives a license fee in excess of the amount prescribed by this section shall revise its liquor license fee structure to conform with the requirement of this section. Any excess funds collected after July 2, 1988 shall be returned or credited annually to existing licensees . FC REPORT No, 600 ADOPTED: `" 1 M2 Your Committee understands that the Liquor Commission adopted a new formula in calculating fees for each licensee. The formula now assesses a fee on all licensees in direct proportion to their revenue from the sale of alcoholic beverages . Each licensee continues to pay the basic fee in addition to this percentage fee. Prior to this amendment, licensees were assessed a percentage fee on their revenue in excess of their basic fees multiplied by 100 . The new formula adopted by the Commission contains a cap of 1%. The preliminary percentage for the fiscal year is . 009288 and will be assessed on all licensees in classes 2, 4 , 5 , 6, 9 , 11, and 12 . The amendment to the Rules and Regulations will bring the method of calculation into compliance with the assessing of the liquor license fees . Your Committee on Finance did not agree that the amendments to the Rules and Regulations of the Liquor Commission of the County of Hawaii be approved by communication. The Finance Committee has filed Communication No . 3982 and requested an appropriate resolution be developed and submitted to the Council for consideration.
