Your Committee on Finance, to which was referred Bill 643, reports as
follows :
The purpose of Bill 643 is to establish a new Article to Chapter 2 of
the Hawaii County Code relating to the Prosecuting Attorney' s office
by providing that the Prosecuting Attorney may appoint deputy
prosecuting attorneys and necessary staff, including investigators .
Investigators shall have all powers and privileges of a police
officer and must meet minimum qualifications for the class as
established by the Department of Personnel Services .
Bill 643 should clearly establish the powers and privileges of our
investigators . With the repeal of Chapter 62 of the Hawaii Revised
Statutes in 1988, it has been interpreted by Corporation Counsel that
such powers and privileges are implied.
Your Committee has reviewed Bill 643 and notes the following
inconsistencies :
1 . The title of the bill proposed to add a new article, the body of
the bill adds a new section to the Code.
2 . The bill references the Department of Personnel Services,
Article VII , Chapter 1 of the Hawaii County Charter recognizes
the Department of Civil Service.
Your Committee has amended Bill 643 to correct the above-mentioned
inconsistencies .

Your Committee was concerned that the Police Department has policies and
standards for training and the exercise of powers and privileges whereas
the Prosecutor ' s office has no such policies and standards . Your
Committee has amended Bill 643 , Draft 2, by providing that the
Prosecutor ' s office adopt the policies and standards of the Police
Department and, further, that the discharge of a firearm shall be
investigated by the Police Department .
Your Committee on Finance concurs with the intent and purpose of
' Bill 643 , Draft 3 , and recommends its approval on first reading.
