Your Committee on Finance, to which was referred Bill 185-86,
reports as follows :
The purpose of Bill 185-86 is to carry out the mandate of
Section 13-7 of the Hawaii County Charter, providing that rules
and regulations having the force and effect of law adopted by
any board, commission or administrative head of a department be
approved by the Council . Bill 185 was introduced by Mr . Steven
Yamashiro and Miss Merle Lai on May 12, 1986 .
On May 27, 1986, Bill 185 was referred to Corporation Counsel
so that Sections 2 and 3 be reviewed.
Your Finance Chair read HRS 91-3 (c) , "The adoption, amendment,
or repeal of any rule by any county agency shall be subject to
the approval of the mayor of the county." This ordinance makes
Bill No. 185 moot .
Your Committee on Finance is not in accord with the intent and
purpose of Bill No. 185 and recommends that Bill No. 185 be
filed.
