HomeMy WebLinkAboutREP FC 579 06/23/1992 REPORT OF THE COMMITTEE ON FINANCE Date: June 23 , 1992 Re: Comm. 3849 Place: Councilroom Time: 10 : 00 a.m. Chairman and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Finance, to which was referred Resolution No . 470-92, reports as follows : The purpose of Resolution No. 470-92 is to request the Mayor to consider the exemption of Hawaiian Homes lands designated for use as houselots, farmlots, and pastoral lots from all County real property taxes . Comm. No. 3849 , from Councilman Spencer K. Schutte, dated June 9, 1992, transmits Resolution 470 which requests Mayor Lorraine R./Inouye to consider the exemption of real property tax assessment of lease lands to the Hawaiian Home Lands recipients who have received houselots, farm lots, and pastoral lots . This request is made since the recipients of Hawaiian Home Lands are granted long term leases and will not benefit from any increases in property values . Councilman Schutte amended Resolution No. 470-92 by amending as follows : NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that it [request the Mayor to consider the exemption of Hawaiian Homes lands designated for use as houselots, farmlots and pastoral lots, from all County real property taxes . ] concurs that Hawaiian Homes lands leased as homestead and not under general lease, pursuant to Section 207 of the Hawaiian Homes Commission Act of 1920 , be exempt from real property taxes in the County of Hawaii . BE IT FURTHER RESOLVED that copies of this resolution be transmitted to [Honorable] Mayor Lorraine R. Inouye; Governor John Waihee; [Mr . Abraham Aiona] Mr. Clayton Hee, Office of Hawaiian Affairs; and to Mrs . Hoaliku Drake, Department of Hawaiian Home Lands . Councilman Schutte excused himself from voting since he is a beneficiary of Hawaiian Home Lands . Your Committee discussed the Department of Hawaiian Home Lands point that these lands cannot be alienated or encumbered, that they do not possess the same benefits as that of freely transferable property.
