Your Committee on Finance, to which was referred Resolution
No . 431-92, reports as follows :
The purpose of Resolution No . 431-92 is to transfer/appropriate Real
Property Tax Division funds for Natural Disaster Claims .

Claims
Communication No . 3493 , from Finance Director William Takaba, dated
March 19 , 1992, transmits Resolution 431 to transfer $79 , 640 .29 from
the Contingency Account to a new Disaster Real Property Claims
account . The purpose of this transfer is to reimburse individuals
who qualify for real property tax relief as a result of the Kalapana
lava flow of January 1983 to April 1990 . A memo from the Real
Property Tax Administrator which requests this resolution is
transmitted.
Your Committee questioned the process of disaster relief since the
Governor appoints a Commission which sets the claims paid by the
County. The following questions were referred to Corporation
Counsel for an opinion:
Can the State require the County to pay disaster
claims without reimbursing the County for the cost of
payments?
Can the County be reimbursed by the Federal Government?
If a taxpayer owns two (2) parcels of property, one
parcel is covered by lava and the other parcel is
outside the disaster area, does the County only pay a
disaster claim for the property within the disaster
zone?

Your Committee on Finance requests that Corporation Counsel render
an opinion on this matter when Resolution 431 comes up for adoption
before the Council .
