Your Committee on Finance, to which was referred Communication
No . 3392, reports as follows :
The purpose of Communication No . 3392 is to request for County paid
legal counsel .
Communication No . 3392 is a copy of a letter to Mayor Lorraine R.
Inouye, County Council, Police Chief Victor V. Vierra, and the
Hawaii County Police Commission, from Assistant Corporation Counsel
Steven Christensen, dated March 4 , 1992 . This communication
transmits a request from William S. Perreira, presently employed at
the Prosecutor ' s Office, for a County-paid legal counsel respecting
a subpoena duces tecum that he received.
Assistant Corporation Counsel Gerald Takase rendered the opinion
that your Committee could go into executive session on the matter .
Mr . Hugh Clark, Press Club, believed the session could be open
because Mr . Perreira is not currently a defendent or plaintiff in
this action and he waived his right to privacy. Your Committee
decided to discuss in open session whether the Council appropriate
money for outside counsel for him.
Mr . Takase stated that the Council can authorize or appoint counsel
to be appointed to Mr . Perreira, but it ' s his opinion at this time
that it is not warranted.
According to Section 5-2 . 5 . of the County Charter, the council may,
by two-thirds vote of its entire membership, authorize the
employment of special counsel for any special matter presenting a
real necessity for such employment . Any authorization shall specify
the compensation, if any, to be paid for said services .

Your Committee on Finance recommends to deny the request of
William S. Perreira for County paid legal counsel since Corporation
Counsel deemed there was no real necessity to employ outside counsel .
