Your Committee on Finance, to which was referred Bill 483 , reports
as follows :
The purpose of Bill 483 is to extend the 1991 deadline for filing a
petition to dedicate one' s property to non-speculative use and be
assessed according to the non-speculative residential use provisions
set forth in Article 7, Chapter 19 , Section 19-58 . 1 and 19-58 .2 .
The present deadline is September 1 of any calendar year . This
ordinance would move the deadline for 1991 to November 1 to petition
for non-speculative residential use status for the 1992 tax year .
Any year after 1991, petition is due before September 1 of the
calendar year in order to qualify for the following tax year :
Section 2 . Article 7, Chapter 19 , Section 19-58 . 1(h) is amended as
follows :
(h) The director shall prescribe the form of the petition. The
petition shall be filed with the director by [September 1 of any
calendar year] November 1, 1991 and shall be approved or disapproved
by December 31, [of that year] 1991, in order to qualify for the
following tax year . In any year after 1991, the petition shall be
filed with the director by September 1 of any calendar year and
shall be approved or disapproved by December 31 of that year .
Your Committee received for its review Bill 483 , Draft 2, which, in
addition to the aforementioned amendments to Section 19-58 . 1,
proposes the following amendments to Section 3 . Article 7,
Chapter 19 , Section 19-58 . 2(a) .
(a) Property, approved for Non-Speculative
Residential Use dedication, shall be assessed at the
real property tax valuation which existed [at the time
the petition was approved. ] on January 1 of the
calendar year following the petition' s approval .
Your Committee heard testimony from the Administration' s Real
Property Tax Office as to the purpose of the proposed amendment .
The proposed change is consistent with dates cited in
Section 19-58 . 1(i) and allows RPT assessors time from receipt and
approval of dedication petitions the opportunity to investigate use
and make up-to-date property assessments of the subject properties .

Your Committee was informed the Administration is in the process of
promulgating the administrative rules and regulations for the
dedication program and would submit to the Council this month a
complete schedule of proposed public hearings and information
meetings, as well as schedule a Council workshop on this subject .
Your Committee has agreed that although the proposed Bill 483 was
not perfect, the subject has been deliberated for years by elected
officials, administrators and public. Some members expressed
concerns related to stated exclusions and mechanics of administering
the program but agreed a workshop to more fully discuss these issues
was the appropriate forum to more fully evaluate the proposed
ordinance and make suggested amendments .
Material to be repealed is bracketed. New material is underscored.
Your Committee on Finance is in accord with the intent and purpose
of Bill 483 , Draft 2, and recommends that it pass first reading .
