Your Committee on Finance, to which was referred Bill 428, reports
as follows :
The purpose of Bill 428 is to define the term "encumbrance" and
thereby clarify that appropriations of state, federal and private
money received for specific purposes are considered encumbered at
fiscal year end if the grant is not complete.
Communication No . 2511, dated April 19 , 1991, from Finance Director
William Takaba, informs that although the term "encumbrance" is
widely used in the County Code, the County Charter and the Hawaii
Revised Statutes, there is no legal definition of the term in any of
those documents .
Also transmitted for Committee review were copies of opinions
rendered by the Corporation Counsel on subjects related to
"certification of funds as an encumbrance of funds" (from Gerald
Takase, dated January 27, 1989) and "Lapse of Appropriations" (from
Frederick Giannini , dated February 8, 1991 .)
Your Committee on Finance is in accord with the intent and purpose
of Bill 428 and recommends that it pass first reading .
