Your Committee on Finance, to which was referred Resolution
No . 283-91, reports as follows :
The purpose of Resolution No. 283-91 is to authorize and empower the
Corporation Counsel to initiate proceedings in eminent domain to
acquire, through condemnation, the Hilo Professional Building site,
improvements and appurtenances .
Resolution 283-91 further proposes to authorize the Corporation
Counsel to negotiate terms of settlement, subject to approval of the
Council and Court.
Resolution 283-91 proposes the subject property is contiguous to the
existing East Hawaii Cultural Center and thereby necessary to obtain
for proposed improvement and expansion for public use and purpose.
In this regard, your Committee understands that all reasonable
offers to purchase said property have been refused and therefore
resolves acquisition through condemnation is appropriate.
Chapter 101, Section(s) 6, 13 and 14 of the Hawaii Revised Statutes
extend and recognize County authority to exercise the right of
eminent domain when it is deemed necessary. It further states
proceedings may be instituted after the County Council has
authorized such suit by approved resolution.
Your Committee on Finance concurs with the intent of Resolution
No. 283-91 and recommends its adoption.
