Home My WebLink AboutRES 031 Draft 01 1998-2000 COUNTY OF HAWAII STATE OF HAWAII RESOLUTION N0. 31 99 RESOLUTION ACCEPTING THE DEDICATION OF ROADWAY LOTS WITHIN SUNRISE RIDGE INCREMENT II SUBDIVISION FROM SUNRISE RIDGE II HOMEOWNERS ASSOCIATION, TAX MAP KEYS (3)2-3-43-010, 2-4-67-039, and 2-4-67-040, TO THE COUNTY OF HAWAII. WHEREAS, SUNRISE RIDGE II HOMEOWNERS ASSOCIATION, a nonprofit corporation, is the owner of Roadway Lots A, B, 138-B, 376 and 393 in the Sunrise Ridge Increment II Subdivision, and the owner of those certain roadway lots located in South Hilo, Hawaii, specifically identified as Tax Map Keys (3)2-3-43-010, 2-4-67-039, and 2-4-67-040, being more particularly described in Exhibit A and delineated on Exhibit B attached hereto; and WHEREAS, Sunrise Ridge II Partners, the original developers, have constructed all subdivision improvements as required for final subdivision approval; and WHEREAS, Sunrise Ridge II Partners had previously received approval from the County of Hawaii's Department of Public Works, Department of Water Supply and the Planning Department for the improvements made to the subject property, and Sunrise Ridge II Homeowners Association is desirous of dedicating the subject parcels to the County of Hawaii for road, drainage, and sewer purposes; and WHEREAS, the subject road, drainage and sewage improvements had been completed according to County of Hawaii standards and were in acceptable condition for dedication; and WHEREAS, Section 23-10 ofthe Hawaii County Code requires that the acceptance of such road, drainage and sewage improvements be in compliance with Chapter 23 of the subdivision code; and WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter, provides that the Council may accept gifts which include the dedication of land on behalf of the County of Hawaii; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in accordance with Article XIII, Section 13-12 of the Hawaii County Charter, and Section 23-10 of the Hawaii County Code, that the County of Hawaii accepts the dedication deed for real properties identified as Tax Map Keys (3)2-3-43-010, 2-4-67-039, and 2-4-67-040, for road, drainage, and sewage purposes.
