RESOLUTION ACCEPTING THE DEDICATION OF ROADWAY LOTS WITHIN SUNSET
RIDGE AT WAIKOLOA, PHASE 3, UNIT 1, FROM SUNSET RIDGE JOINT VENTURE,
TAX MAP KEY (3)6-8-032-PORTION 046, TO THE COUNTY OF HAWAII.
WHEREAS, SUNSET RIDGE JOINT VENTURE, a Hawaii general partnership, is the
developer of Sunset Ridge at Waikoloa, Phase 3, Unit 1, and the owner of those certain roadway
lots located in Waikoloa, District of South Kohala, Hawaii, specifically identified as Tax Map
Key (3)6-8-032-Portion 046, being more particulazly described in Exhibit A and delineated on
Exhibit B attached hereto; and
WHEREAS, Sunset Ridge Joint Venture has constructed all subdivision improvements as
required for final subdivision approval; and
WHEREAS, Sunset Ridge Joint Venture has received approval from the County of
Hawaii's Department of Public Works, Department of Water Supply and the Planning
Department for the improvements made to the subject property, and aze desirous of dedicating
the subject pazcels to the County of Hawaii for road and drainage purposes; and
WHEREAS, the subject road and drainage improvements have been completed according
to County of Hawaii standazds and aze in acceptable condition for dedication; and
WHEREAS, Section 23-10 of the Hawaii County Code requires that the acceptance of
such road and drainage improvements be in compliance with Chapter 23 of the subdivision code;
and
WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter, provides that the
Council may accept gifts which include the dedication of land on behalf of the County of Hawaii;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII, in accordance with Article XIII, Section 13-12 of the Hawaii County Charter, and
Section 23-10 of the Hawaii County Code, that the County of Hawaii accepts the dedication deed
for real property identified as Tax Map Key (3)6-8-032-Portion 046 for road and drainage
purposes.

Island and County of Hawaii, State of Hawaii, being a portion of Royal Patent 5671, Land
Commission Award fS21-B, Apaoa 1 to G. D. Htrar, being more particularly described as follows:
LOT 49, area 19,050 square feet, more or less; and
LOT S0, area 14,550 square feet. more of less;
of the "SUNSET RIDGE AT WAIKOLOA, PHASE 3, UMT 1", as shown on File Plan No. 2213,
filed in the Bureau of Conveyarrtxs of the State of }lawad.
Together with all rights and privileges conferred upon owners of lots within the
Waikoloa Village Subdivision by that certain Declaration of Protective Covenants, Conditions and
Restrictions dated May 27, 1971. recorded in the Bureau of Conveyances of the State of Hawaii in
Libor 7577 at Page 66, as rtow or hereafter amended and supplemented (the "Declaration"), the
aforementioned property being made subject thereto by supplemental Declaration dated March I.
1990. recorded as Document No. 90-029591; and
Being a portion of the land conveyed to Sunset Ridge Joint Venttue, a Hawaii general
partnership, by Deed dated October 19, 1990, recorded in the Bureau of Conveyances of the State
of Hawaii as Document No. 90-163144.
