Home My WebLink AboutRES 328 Draft 02 1998-2000 COUNTY OF HAWAII STATE OF HAWAII RESOLUTION NO. 329 00 (DRAFT 2) RESOLUTION AUTHORIZING THE GRANT OF A WATER LINE EASEMENT AT KAAPOKO HOMESTEADS, SOUTH HILO, HAWAII, [BLAND, COUNTY AND STATE OF HAWAII, TAX MAP KEY NO. (3)2-7-OS TO CYRUS M. WAGATSUMA, NAGATA FAMILY TRUST, DOROTHY D. PATAO AND JAMES R. KENNEDY AND LINDA C. KENNEDY. WHEREAS, Chapter 2, Article 19, Section 2-111, of the Hawaii County Code provides that the County Council may, by resolution approved by a majority of its members, dispose of real property; and WHEREAS, the County of Hawaii is the owner of that certain homestead road located at Kaapoko Homestead, South Hilo, Hawaii, Island, County and State of Hawaii as shown on the enclosed tax map; and WHEREAS, the Department of Public Works, Engineering Division, has issued a conditional permit to the owners to install the waterline, to serve their water needs; and WHEREAS, the owners are requesting the County of Hawaii to grant a waterline easement, subject, however, to reversion to the County upon termination or abandonment of the easement for the specific purposes for which it was granted; and WHEREAS, an independent appraiser determined that the fair market value of the waterline easement is $2,000.00 with an area of 6,231 square feet. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in accordance with Chapter 2, Article 19, Section 2-111 of the Hawaii County Code, that the County of Hawaii authorizes a grant of an easement for the installation of waterline to Cyrus M. Wagatsuma, Nagata Family Trust, Dorothy D. Patao, James R. Kennedy and Linda C. Kennedy. BE IT FURTHER RESOLVED, that the Clerk of the County of Hawaii transmits copies of this resolution to Robert Yanabu, Chief Engineer, Milton D.
