RESOLUTION NO. 3~9
RESOLUTION ACCEPTING ROYAL POINCIANA DRIVE EXTENSION (TAX MAP KEY
NO. 7-16-024:026), AND THE KUPUNA STREET EXTENSION (TAX MAP KEY
NO. 2-16-024:078), HOLUALOA, NORTH KONA, AS A COUNTY ROAD.
WHEREAS, Royal Poinciana Drive Extension and the Kupuna Street Extension connects
Royal Poinciana Drive with Kupuna Street and Lako Street in Kona (as shown on Exhibit "A"
attached), which is currently open and serving the public; and
WHEREAS, this road provides an important access for the residents of the surrounding
subdivisions and mauka/makai connection between Ali`i Drive and Kuakini/Queen Ka`ahumanu
Highway through Lako Street and Royal Poinciana Drive; and
WHEREAS, no person has exercised any acts of ownership over this road for more than
five years; and
WHEREAS, the road will fall into a state of disrepair without maintenance; and
WHEREAS, Hawaii Revised Statutes, §264-1 provides that where no act of ownership
has been exercised over a road, way, or lane for more than five years and, in the case of a County
highway, where the legislative body has accepted the same by resolution, the road, way, or lane
shall become a County highway by surrender.
BE IT THEREFORE RESOLVED, by the Council of the County of Hawaii, that Royal
Poinciana Drive Extension (Tax Map Key No. 7-16-024:026) and the Kupuna Street Extension
(Tax Map Key 7-16-024:078), Holualoa, North Kona, between Royal Poinciana Drive and
Kupuna Street, as shown on Exhibit "A" attached hereto, which has had no acts of ownership
taken on it in over 5 years, is hereby accepted as a County highway, by surrender, pursuant to
§264-1, HRS; and
BE IT FURTHER RESOLVED that the Clerk file a certified copy of this resolution with
the State Bureau of Conveyances and provide further copies to the Mayor, the Chief Engineer,
and the Director of Finance.
