RE: Communication No. 1084 /Bill No. 340, Draft 2. Ordinance bill amending
the capital budget by appropriating $2 million for TEA -21 projects,
$2.5 million for local road improvements, and $500,000 for roads -in-
limbo projects.
With regard to the aforementioned measure (attached), please provide an opinion as to
the legality of funding roads that fall within the auspices of Section 264 -2, Hawaii
Revised Statutes, identified as "Roads -In- Limbo" in Exhibit A, with funds derived from
fuel tax revenues.
It is my understanding that Section 243 -6, Hawaii Revised Statutes, Fuel taxes,
dispositions, may not provide for the funding of such roads.
Your prompt reply is appreciated as this resolution is agendized for the February 2, 1999,
Committee on Finance meeting.
