My name is Herb Gallagher and I represent the East and the West Waikoekoe
Property Owners Associations. These aze comprised of 26 sepazate owners of
whom 7 are already built and the rest either building or getting ready. There aze
other abuttors such as Mr. and Mrs. George Davis whom I represent and Mr.
Takahashi whom I have not had the opportunity to meet. The County Road in
question is:
MUD LANE:
Corporation Counsel said at a public meeting of the Public Works Committee
on November S , 1998, that Mud Lane was a county road We requested the
County a[ that meeting to take over the reasonable maintenance of MUD LANE
So much for the preamble; I would like now t o to deal with financing and some
necessary procedures .
We have in hand drafts 1. and 2. of Bill 340. Draft One speaks of Roads in Limbo
and sets aside $100,000 for each District to deal with the problem. There is no mention
of why it is not pro rata according to the ntunber of miles of Roads in Limbo in each District.
Be that as it may, at least it is a beginning.
Draft two is entirely silent on "Roads in Limbo". We implore you to reject this version;- better
to make a beginning to solve the problem and get it off your agenda. Your next problem is
to define and more appropriately to categorize "Roads in Limbo " .
There aze two problems ;one is categories in a legal sense, the other is priority in a public safety
sense as follows:
CATEGORIES IN A DESCENDING ORDER
OF LEGAL PRESCEDENCE:
1. All Roads which have been historically on the tax maps as government roads which
now aze in fact County Roads unless:

2. They aze understood to be Federal or State Roads or Trails since Statehood.
[ These will require resolution between the State and County and thence Federal]
3. All Roads which aze on private land or easements on same which by some
historical or other priority may be necessary to include. Otherwise no roads on private land
will be included. [adjudication of these issues will be required
PRIORITIES OF ACTION
A. Roads which by decision of District or County Public Safety Committee
aze adjudged impassable or at high risk to the public usor. This must be stated
in detail
B. Roads which by decision of the suggested Road Commission aze adjudged to
prevent proper usage by public safety vehicles [Fire and Police as stated
by Fue and Police
ROADS COMMISSION
Some sort of commission might be established to deal with the issues
that aze raised by the above adjudications. Perhaps a member of PUBLIC
WORKS staff, a member of PUBLIC SAFETY STAFF and TWO members of
' the public be appointed :one by the Mayor of the County and one by the Chair of
of PUB LIC WORKS.
