RESOLUTION NO. 512 14
RESOLUTION AUTHORIZING THE DEPARTMENT OF PUBLIC WORKS
TO AWARD FUNDS TO PEOPLES ADVOCACY FOR TRAILS HAWAII
(PATH)
WHEREAS, Chapter 2, Article 25, Section 2-139(a)(3)(A) of the Hawaii County Code
(2005 Edition as amended) states, grant awards in excess of$25,000 to nonprofit organizations
shall specifically identify the organization receiving the grant funds and the purpose for which
the grant funds shall be used in an ordinance or resolution.; and
WHEREAS, Chapter 2, Article 25, Section 2-136(5) of the Hawaii County Code states,
"nonprofit organization" means an organization organized for other than profit-making purposes
and which has a current 501(c)3 tax-exemption from the Internal Revenue Code; and
WHEREAS, the Department of Public Works was awarded $94,329.27 from the State of
Hawaii Department of Transportation for the Safe Routes to School (SRTS) program, which
was appropriated via Ordinance 14-95, effective July 10, 2014; and
WHEREAS, Peoples Advocacy for Trails Hawaii (PATH), which qualifies as a nonprofit
organization as defined above, will serve as the SRTS program coordinator; and
WHEREAS, the Department of Public Works wishes to provide this $94,329.27 to PATH;
and
WHEREAS, the grant funds will be used to execute the SRTS program for the County of
Hawaii; and
WHEREAS, the PATH organization will work closely with the Department of Public
Works to identify barriers and infrastructure solutions, as well as to organize local campaigns to
engage parents and caregivers; now, therefore
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in accordance
with Chapter 2, Article 25, Section 2-139(a)(3)(A) of the Hawaii County Code, the Department of
Public Works is authorized to provide a grant of $94,329.27 to PATH to implement the County of
Hawai`i's SRTS program.
BE IT FINALLY RESOLVED that the County Clerk of the County of Hawaii shall
transmit copies of this resolution to the Office of the Mayor, the Finance Department, and the
Department of Public Works.
