April 30,2014 7p David Schlesinger C PO Box 10383 Hilo, Hi 96721 Aloha Na Ohana Testimony from David Schlesinger concerning the budget for the Municiapal Corporation known as the County of Hawaii. As we look forward to the upcoming years, I have a few concerns that I would like to see money appropriated by the County of Hawaii to address. As residents of the island of Hawaii, we know that there is a deep conflict of interest created by the very presence of the United States in the islands and the existence of the State of Hawaii, and the County of Hawaii. One of the major ways all of the residents are affected by this conflict is land title. As a municipal corporation, the county is responsible to assess possible liabilities that exist and do its best to protect it' s interests and residents interests. Since the Hamakua Sugar Lands became an issue back in 2009, the county has been aware that there is a inheritent defect to most title on the island of Hawaii, including most of the land the County holds. With the eviction of Uncle Abel Lui and the County taking possession of the lands at Kawa'a in 2012, the County has knowingly put itself in a position where it is liable for land fraud. I encourage members of the council to not only allocate money to do a real title investigation into lands in Hawaii. Not to rely on the title companies but to open up the records and look at the fact that a foreign title to United States jurisdiction exists and is clouding title here and now. The government must take responsibility at some level, and acknowledging the alloidial title created under Kamehameha III is an excellent first step. The way to do this is to do a real title investigation. There is a large population base on this island that are Hawaiian Nationals and need to be respected for their voice and opinions.
