Box 4148 Kailua Kona, Hawaii 96745 Re: Request for Information Dear Ms. Hecht: The State of Hawaii Campaign Spending Commission ("Commission") is responsible for regulating campaign contributions and expenditures in the state through the administration and enforcement of the campaign finance law. Pursuant to Hawaii Revised Statutes ("HRS")§11-321(g), a noncandidate committee is required to register with the Commission by filing an organizational report within ten days of receiving contributions or making expenditures of more than$1,000, in the aggregate, in a two-year election period. However, if the contributions or expenditures are received or made within thirty days prior to an election,then the organizational report must be filed within two days of receiving the contributions or making the expenditures. HRS§11-302 defines"noncandidate committee" as an organization or individual that receives contributions or makes expenditures"to influence the nomination for election, or the election, of any candidate to office, or for or against any question or issue on the ballot." HRS§11-335 requires a noncandidate committee to report, among other things, all contributions and expenditures to the Commission. Under HRS§11-410, the Commission may assess an administrative fine against an individual or organization for each violation of the campaign finance law. We have been informed that Save Our Lands Citizens Committee ("SOLCC")purchased a half- page advertisement in the Hawaii Tribune Herald that appeared on November 6, 2006, and a half-page advertisement in West Hawaii Today that appeared on November 7, 2006, the day of the general election. The advertisements cost approximately$2,000 each (one time cost), or approximately$4,000 in total. Both advertisements urged a vote for the county ballot issue on the"2% Open Space Fund." SOLCC did not register with or report the advertisement expenditures to the Commission. In order for the Commission to better understand the extent of SOLCC's activities that are or may be subject to regulation by the Commission, please provide answers to the following questions: 1. What kind of organization is SOLCC? 2. During the 2006 election period (2004 general election to 2006 general election), did SOLCC make any contributions to state or county candidates? If so, what was the total amount of contributions made? 3. During the 2006 election period, did SOLCC make any expenditures, including the two advertisements described above, in support or against any state or county candidates or ballot issues? During the 2010 election period (2008 general election to 2010 general election), did SOLCC make any contributions to state or county candidates? If so,what was the total amount of expenditures made? 8. During the 2012 election period (2010 general election to 2012 general election), did SOLCC make any contributions to state or county candidates? If so, what was the total amount of contributions made? 9. During the 2012 election period, did SOLCC make any expenditures in support or against any state or county candidates or ballot issues? If so,what was the total amount of expenditures made? 10. Please identify the individual(s)who authorized each contribution or expenditure made by SOLCC. 11.
