RESOLUTION ACCEPTING THE GRANT OF EASEMENT D-2 FOR DRAINAGE AND
SLOPE PURPOSES NEEDED FOR THE KAPI`OLANI STREET EXTENSION, JOB
NO. E-4039, SITUATE AT WAIAKEA, SOUTH HILO, ISLAND OF HAWAII, HAWAII,
BEING A PORTION OF TAX MAP KEY: (3) 2-4-056:021 (POR.) FROM THE STATE OF
HAWAII, HAWAII PUBLIC HOUSING AUTHORITY.
WHEREAS, The State of Hawaii, Hawaii Public Housing Authority is the owner of
Lot A-1 needed for the Kapi`olani Street Extension, Job No. E-4039, situated at Waiakea, South Hilo,
Island of Hawaii, Hawaii, identified as Tax Map Key: (3) 2-4-056:021 (por.), as delineated on
Exhibit "1" attached hereto; and
WHEREAS, the County of Hawaii is proceeding with Kapi`olani Street Extension, Lanikaula
Street to Mohouli Street. In order to complete the project, the County of Hawaii needs to acquire the
easement for drainage and slope purposes, over and across 62 square feet portion of this lot; and
WHEREAS, The State of Hawaii, Hawaii Public Housing Authority is desirous of granting
the County of Hawaii the perpetual easement described in Exhibit "2" between the University of
Hawaii at Hilo and downtown Hilo. The County's construction of this section of Kapi`olani Street
will further advance the University of Hawaii at Hilo's efforts to develop additional housing and
support facilities in the immediate area; and
WHEREAS, such easement has been approved by the Planning Department, Department of
Public Works, Department of Water Supply and the Department of Environmental Management; and
WHEREAS, Section 23-10 of the Hawaii County Code prohibits the Council from receiving
by dedication any streets in any subdivision platted after December 2, 1966 except upon full
compliance with the provisions of Chapter 23; and

FOR DRAINAGE AND SLOPE PURPOSES
LAND SITUATED AT WAIAKEA, SOUTH HILO,
ISLAND OF HAWAII, HAWAII.
Being a portion of Grant 15,102 to Hawaii Housing Authority.
Being also a portion of Lot A-1.
Beginning at the southwest corner of this easement, being also the southwest corner of
Lot A-1 and on the northeasterly side of Kapiolani Street, the coordinates of said point of
beginning referred to Government Survey Triangulation Station "HALAI", being 3,274.54 feet
South and 5,203.07 feet East, thence running by azimuths measured clockwise from true South:
1. 1480 10' 5.84 feet along Kapiolani Street;
2. Thence along Wailoa River and Tributaries Flood Control Project on a curve to the left
with a radius of 2,380.00 feet, the chord
azimuth and distance being:
1970 39' 02.5" 9.21 feet;
3. 3280 10' 11.82 feet along the remainder of Grant 15,102 to
Hawaii Housing Authority (remainder of Lot
A-1);
4. 580 10' 7.00 feet along Government Land (Lot B-2) to the point
of beginning and containing an area of 62
