REPORT OF THE <br />COMMITTEE ON FINANCE <br />REGARDING: BILL NO. 194 (COMMUNICATION NO. 654) <br />DATE: OCTOBER 14, 2014 <br />LOCATION: KONA COUNCIL CHAMBERS, HILO, HAWAII <br />TIME: 11:14 A.M. <br />TITLE: AN ORDINANCE AMENDING CHAPTER 21, ARTICLE 4, <br />SECTION 21-32 OF THE HAWAII COUNTY CODE 1983 (2005 <br />EDITION, AS AMENDED), RELATING TO BILLING OF CHARGES; <br />PAYMENT; LATE PENALTY. <br />EXPLANATION: Transmitted by Finance Director Nancy Crawford on January 30, 2014, <br />this legislation authorizes the Department of Water Supply to terminate <br />water services for non-payment of sewer services charges when so <br />directed by the Director of Environmental Management after due notice <br />and opportunity for a hearing before the Environmental Management <br />Commission, and the resolution of any appeal therefrom, as provided by <br />Chapter 91, Hawaii Revised Statutes. <br />On February 18, 2014, the Finance Committee postponed and referred this <br />bill to the Environmental Management Director and the Environmental <br />Management Commission for review and comment. Reference <br />Communication No. 654.1. <br />As stated in Communication No. 654.3, both the Director of <br />Environmental Management and the Commission of Environmental <br />Management reviewed the bill and fully support Council approval of <br />Bill No. 194 as it will assist in collection of delinquent accounts. <br />As stated in Communication No. 654.4, the Department of Water Supply <br />Manager -Chief Engineer Quirino Antonio, Jr., indicates no objections to <br />Bill No. 194. <br />On September 16, 2014, the Finance Committee postponed Bill No. 194 to <br />the call of the Chair. <br />In the course of the Finance Committee meeting on October 14, 2014, the <br />Council amended Bill No. 194 with the contents of Comm. No. 654.6, <br />proposed by Ms. Wille. This amendment amends the bill by changing <br />FC Report No. 201 <br />
