REGARDING: BILL NO. 194 (COMMUNICATION NO. 654)

TITLE: AN ORDINANCE AMENDING CHAPTER 21, ARTICLE 4,
SECTION 21-32 OF THE HAWAII COUNTY CODE 1983 (2005
EDITION, AS AMENDED), RELATING TO BILLING OF CHARGES;
PAYMENT; LATE PENALTY.
EXPLANATION: Transmitted by Finance Director Nancy Crawford on January 30, 2014,
this legislation authorizes the Department of Water Supply to terminate
water services for non-payment of sewer services charges when so
directed by the Director of Environmental Management after due notice
and opportunity for a hearing before the Environmental Management
Commission, and the resolution of any appeal therefrom, as provided by
Chapter 91, Hawaii Revised Statutes.
On February 18, 2014, the Finance Committee postponed and referred this
bill to the Environmental Management Director and the Environmental
Management Commission for review and comment. Reference
Communication No. 654.1.
As stated in Communication No. 654.3, both the Director of
Environmental Management and the Commission of Environmental
Management reviewed the bill and fully support Council approval of
Bill No. 194 as it will assist in collection of delinquent accounts.
As stated in Communication No. 654.4, the Department of Water Supply
Manager -Chief Engineer Quirino Antonio, Jr., indicates no objections to
Bill No. 194.
On September 16, 2014, the Finance Committee postponed Bill No. 194 to
the call of the Chair.
In the course of the Finance Committee meeting on October 14, 2014, the
Council amended Bill No. 194 with the contents of Comm. No. 654.6,
proposed by Ms. Wille. This amendment amends the bill by changing

AMENDMENTS
language in Section 4 to read, "This ordinance shall take effect
December 31, 2015."

RECOMM.: Your Committee on Finance is not in accord with the purpose and intent
of Bill No. 194, as amended to Draft 2, and moves it forward to Council
with a negative recommendation.
For informational purposes, Council Members Eoff, Kern and Poindexter
voted "kanalua" then "no" and Council Member Kanuha voted "kanalua"
then "aye."
