Yoshimoto, Chairman, and Council Members re' Hawai`i County Council 4 = 25 Aupuni Street Hilo, Hawai`i 96720 Dear Chairman Yoshimoto and Council Members: RE: Bill 316 Amends Chapter 15, Article 8, Section 15-68.1 of the Hawaii County Code 1983 (2005 Education, as Amended), Relating to Parks and Recreation Facility Schedule. I am writing regarding the attached proposed ordinance to name the soon to be completed gym and emergency shelter after Laurence Capellas and Robert"Bob” Herkes. It is my recommendation the proposed ordinance not be considered at this time. The new gym and emergency shelter is not a County of Hawai`i ("County") owned or managed facility over which we have the authority to name pursuant to Hawaii County Code Sections 15-67 and 15-68.1. The new gymnasium and emergency shelter is being constructed on land owned and managed by the Department of Education ("DOE"), with funds given to the County by the State of Hawaii. While the construction project is being implemented by the County's Department of Public Works, and the County has contributed some funding towards construction, the County does not currently have any ownership interest in the new facility. Construction on the facility is scheduled to be completed in February 2015 and the Department of Parks and Recreation is currently working with the DOE on the joint use, operation and maintenance of the new facility. That process is still in the works but the Department of Parks and Recreation anticipates that will be completed within the next four months. Comm. N 113 q.
