RESOLUTION NO. 598 14
RESOLUTION AUTHORIZING THE OFFICE OF THE PROSECUTING ATTORNEY
TO ENTER INTO AN AGREEMENT WITH THE STATE OF HAWAII, DEPARTMENT
OF PUBLIC SAFETY, SHERIFF DIVISION, HAWAII ISLAND SECTION, PURSUANT
TO HRS 46 -7, AND TRANSFER OWNERSHIP OF TWO (2) LIVESCAN UNITS
(INCLUDES A LAPTOP, CAMERA AND CASE), TWO (2) DELL LATITUDE E.5510
LAPTOPS AND TWO (2) DELL LASER PRINTERS TO THE STATE OF HAWAII,
DEPARTMENT OF PUBLIC SAFETY, SHERIFF DIVISION, HAWAII ISLAND
SECTION.
WHEREAS, in 2011 and 2012, the Office of the Prosecuting Attorney acquired through
Federal grant funds under the Courthouse Booking Program, (2) Livescan Units (includes a
laptop, camera and case), (2) Dell Latitude E5510 laptops and (2) Dell Laser printers; and that
pursuant to an inter - agency agreement under the grant, this equipment was used by Deputy
Sheriffs in the courthouses in Hilo and Kona to process offenders at the courthouse, rather than
have them report to the police stations for processing at a later time; and that the activities under
this grant resulted in more accurate records, saved police and court resources; and
WHEREAS, Hawai'i Revised Statutes, Section 46 -7, requires that County departments
obtain consent of the Council to enter into agreements with the federal or state governments
respecting action to be taken pursuant to any of the powers granted by law to furnish, expend,
and receive any funds or other assistance in connection with projects being or to be undertaken
pursuant to those powers; and
WHEREAS, the State of Hawaii, Department of Public Safety, Sheriff Division, has executed
an indemnification agreement with the County of Hawaii, and has possession of said equipment
since they were received and are utilized on a daily basis to facilitate court ordered processing;
and
WHEREAS, one unit is located at the Hilo court house, Hale Kaulike, located at 777
Kilauea Avenue, Hilo, Hawaii and one unit is located at the Kona court house located at 79-
1020 Haukapila Street, Kealakekua, Hawaii; and
WHEREAS, Hawaii Revised Statutes Section 46 -7 provides that the Office of the
Prosecuting Attorney, with the consent of the Council, on behalf of the County of Hawaii, may
furnish or expend funds or other assistance in connection with projects or to be undertaken
pursuant to its governing powers; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in accordance
with Hawaii Revised Statutes Section 46 -7, that the Office of the Prosecuting Attorney and the
Mayor of the County of Hawaii are authorized to execute, on behalf of the County, an
agreement and related documents with the State of Hawai'i Department of Public Safety, in order
to transfer ownership of the above equipment and provide indemnification for the county
regarding the transaction with the consent of the Council of the County of Hawaii.
BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to: (1) the
State of Hawaii, Department of Public Safety, Sheriff's Division; (2) Mayor William P. Kenoi;
(3) the County Office of the Prosecuting Attorney; (4) County Department of Finance; and (5)
County Office of the Corporation Counsel.
