Re: Agreement with the State of Hawaii Department of Public Safety
In 2011 and 2012, the Office of the Prosecuting Attorney acquired through federal grant funds, two
Livescan Units, two Dell laptop computers and two Dell laser printers. Pursuant to an inter - agency
agreement under this grant, the equipment was for use by Deputy Sheriffs in the Kona and Hilo
courthouses. Though the equipment has been in the possession of and in use by the Sherriff
Division since it was acquired, it has officially belonged to the County of Hawaii and has been
recorded on County inventory. The State of Hawaii Department of Public Safety's Sheriff
Division has agreed to officially take possession, and thus, responsibility of this equipment.
Enclosed is a resolution authorizing the Mayor to enter into an agreement with the State of Hawaii
Department of Public Safety to transfer the equipment and indemnify the County from any
responsibility from use or ownership of this equipment once transferred. If there are any questions,

To enter into an agreement with the Department of Public Safety, Sheriff Division, Hawai'i Island section
indemnifying the County in regards to the Sheriffs office accepting Courthouse Booking equipment.
To transfer 2 livescan Units, 2 Dell Lattitude E5510 Laptops, 2 Dell printers to the Sheriffs Division.
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
In 2011 and 2012, the Office of the Prosecuting Attorney acquired through Federal grant funds under the
Courthouse Booking Program, (2) Livescan Units (includes a laptop, camera and case), (2) Dell Latitude
E5510 laptops and (2) Dell Laser printers; and that pursuant to an inter - agency agreement under the grant,
this equipment was used by Deputy Sheriffs in the courthouses in Hilo and Kona to process offenders at the
courthouse, rather than have them report to the police stations for processing at a later time; and that the
activities under this grant resulted in more accurate records, saved police and court resources.
There is no reason the County or Prosecutor's Office needs to continue to have this equipment on its
inventory as the Sheriffs department is fully in control of it and willing to accpet the transfer.
An agreement to indemnify the county from any responsibility for use or ownership of the equipment was
signed in July 2014 by the sheriff's office.
This resolution would ask the Council to give permission to go into an indemnity agreement with the Sheriffs
Division and transfer the equipment to them.

RESOLUTION AUTHORIZING THE OFFICE OF THE
PROSECUTING ATTORNEY TO ENTER INTO AN AGREEMENT WITH THE STATE OF
HAWAII, DEPARTMENT OF PUBLIC SAFETY, SHERIFF DIVISION, HAWAII ISLAND
SECTION, PURSUANT TO HRS 46 -7, AND TRANSFER OWNERSHIP OF TWO (2) LIVESCAN
UNITS (INCLUDES A LAPTOP, CAMERA AND CASE), TWO (2) DELL LATITUDE E5510
LAPTOPS AND TWO (2) DELL LASER PRINTERS TO THE STATE OF HAWAII,
DEPARTMENT OF PUBLIC SAFETY, SHERIFF DIVISION, HAWAII ISLAND SECTION.
Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawaii, this written request is submitted with my approval that the above - referenced matter be
waived from the Committee on Finance to the full Council for immediate action. In reviewing
this matter, timely approval is crucial. It is therefore advantageous that approval is granted and
the matter be placed onto the next Council agenda for review. However, in the event this request
is denied, for whatever reason, I understand the matter shall be referred to the Committee on
Finance for placement on its future agenda.
