TITLE: AN ORDINANCE AMENDING SECTION 25-8-26 (PAHOA ZONE
MAP), ARTICLE 8, CHAPTER 25 (ZONING CODE) OF THE
HAWAII COUNTY CODE 1983 (2005 EDITION), BY CHANGING
THE DISTRICT CLASSIFICATION FROM SINGLE- FAMILY
RESIDENTIAL — 15,000 SQUARE FEET (RS -15) TO VILLAGE
COMMERCIAL — 10,000 SQUARE FEET (CV -10) AT NANAWALE
HOMESTEADS, PUNA, HAWAII, COVERED BY TAX MAP KEY:
1-5-014:005.
EXPLANATION: Bill No. 303 was transmitted by the Mayor William P. Kenoi, via
Communication No. 1094, dated September 18, 2014. The area covers
approximately 42,856 square feet. The applicant is Paul Ogasawara.
The Windward Planning Commission forwards it favorable
recommendation for this change of zone, which would allow the applicant
to construct a commercial office and retail complex on Village Road
consisting of approximately 7,500 square feet.
No testifiers were present for this item. Although, the applicant's
planning consultant, Sidney Fuke, was present in Hilo to provide comment
and answer questions by committee members. Prior to discussion by
committee members, Mr. Fuke gave a brief summary of the applicant's
intent to build 3-4 buildings for small businesses and the possible effects
his property and development will have should the June 27th lava flow
claim his property. After consulting with the applicant, Mr. Fuke shared
that the applicant will move forward with the rezoning should the Council
approve. In regards to the June 27th lava flow, developments on this
property will proceed at the discretion of the applicant. Sidney Fuke
closed his comment by asking committee members to favorably consider
rezoning application.

Ms. Wille began discussion by reiterating Mr Fuke's statement advising
the applicant has accepted the conditions requested by the Planning
Director and the Planning Commissions. Mr. Onishi continued discussion
by inquiring with Mr. Fuke if affordable housing or a rental system could
be a possibility after the rezoning. Mr. Fuke advised the application is to
rezone for commercial purposes, therefore, it is an option. No further
discussion was held.
