Lia—m No. rile ,:tic> . i County of Hawaii—State of Hawaii Resolution NO. — WHEREAS, a portion of the Old Government Road located at Keauhou Bay, North Kona, Hawaii has not been abandoned; and WHEREAS, said portion of roadway is no longer of any use to the County of Hawaii; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that a portion of the Old Government Road located at Keauhou Bay North Kona, Hawaii, as delineated in red on the map attached hereto and marked Exhibit A, be and is hereby declared abandoned as a roadway on condition that the abandonment shall become effective upon the completion of the requirements pursuant to the Planning Department's PUD Permit No. 9 and shall be subject to the submittal and acceptance of the following documents: a. That Bishop Estate shall dedicate that portion of the present roadway north of the state wharf deeded by Lyman Perry -Fisk to Bishop Estate on May 7, 1965 by deed recorded in Book 5055, Page 349 of the Bureau of Conveyances, to the County of Hwwraii. b. That Bishop Estate shall dedicate additional right-of-way as necessary on the north and south approaches to Keauhou Bay to the County of Hawaii to conform to County Planning Department's requirements pursuant 0 to PUD Permit No. 9. c. That Bishop Estate shall quitclaim its reversionary interest under Bishop Estate deed dated December 319 1947, to the County of Hawaii (County Clerk File No. 619). BE IT FURTHER RESOLVED that the County Clerk be authorized and directed to forward a copy of this resolution to the Bishop Estate, Kameha- meha Development Corporation, Department of Land and Natural Resources, State Department of Transportation (Harbors Division), and to the Department of Public Works of the County of Hawaii. BE IT FURTHER RESOLVED that the County Clerk be authorized and directed to forward a copy of this resolution to the Kamehameha Development Corporation, Bernice P.
