RES. 545 -14 - 2015 HSAC LEGISLATIVE PACKAGE;
A BILL RELATING TO ABUSE OF A FAMILY OR HOUSEHOLD MEMBER

Chair Yoshimoto, Vice Chair Eoff and Members of the Council:
The Department of the Prosecuting Attorney, County of Maui, SUPPORTS Res. 545 -14,
2015 HSAC Legislative Package, including a bill relating to Abuse of a Family or Household
Member.
Our department advocated for a bill to provide that the 48 -hour warning order issued by a
police officer in domestic violence situations be extended to the second business day following a
weekend or legal holiday. The legislature extended the "stay away period" from 24 to 48 hours
in 2013, presumably to give victims of domestic violence enough time to obtain assistance,
prepare a petition for a protective order, have a judge review and approve the order, and to have
to order served on the other party. However, the legislature failed to provide two business days
for incidents occurring on a weekend or legal holiday. In those situations, the victim only has
one business day before the "stay away" order from the police officer expires. This is clearly not
enough time for a victim to have a protective order prepared, reviewed, approved and served.
The bill included in Res. 545 -14 will help ensure that these victims receive enough time to obtain
and serve a protective order before the police- issued order expires.
Accordingly, the Department of the Prosecuting Attorney, County of Maui, SUPPORTS
Res.545 -14, and urges its adoption.
