RESOLUTION No. 208 00

RESOLUTION PROVIDING FOR THE ACQUISITION OF PRIVATE PROPERTY, BEING A
PORTION OF TAX MAP KEYS (3)3-5-003-027 AND 3-5-004-008, SITUATE AT
PAPA`ALOA, NORTH HILO, HAWAII, FOR A PUBLIC RIGHT-OF-WAY.
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI`[
WHEREAS, Jack Ramos Ranch, Inc. is the owner of Road Lot "A" and Swale Easements
1 and 2, being portions of Tax Map Keys (3)3-5-003-027 and 3-5-004-008, more particularly
described in Exhibit "A" attached hereto, and shown on Exhibits "B" and "C" attached hereto;
and
WHEREAS, the subject roadway, identified as Road Lot "A," from the end of Papa`aloa
Subdivision, Increment I-A to Ochiro Road, has been providing access to the surrounding
landowners after a section of Ochiro Road servicing the area fell into the gulch; and
WHEREAS, that portion of Ochiro Road which fell into the gulch should also be
abandoned as a roadway as highlighted on Exhibits "B" and "C"; and
WHEREAS, Jack Ramos Ranch, Inc. is willing to acquire Ochiro Road if it is abandoned;
and
WHEREAS, the County has deemed it necessary to exercise its right of eminent domain
in acquiring the subject roadway for the purpose of insuring a continuing public access to the
residents of surrounding area; and
WHEREAS, Section 101-13 ofthe Hawaii Revised Statutes, requires that a
condemnation action by the County must be authorized by a resolution of the County Council;
and
WHEREAS, Sections 2-111 and 2-118 of the Hawaii County Code authorizes the
disposal of road remnants by offer of sale to the abutting owner.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII, that it is necessary for the public use and purpose, to wit: the maintenance, operation
and improvement of Road Lot "A" situate at Papa`aloa, N. Hilo, Hawaii, to take, acquire and
condemn that certain roadway identified as being a portion of Tax Map Keys (3)3-5-003-027 and
3-5-004-008, described in Exhibit "A" attached hereto and made a part hereof by reference.
BE IT FURTHER RESOLVED that the Corporation Counsel of the County of Hawaii
be and is hereby authorized and empowered to initiate proceedings in eminent domain, as
provided by law, for the taking, acquisition and condemnation of the aforesaid roadway, together
with any adjacent lands necessary for temporary construction purposes.
BE IT FURTHER RESOLVED that in the process of said proceedings in eminent
domain, the Corporation Counsel be and is hereby authorized and empowered to negotiate terms
of settlement, subject to the approval of the court before which such proceedings are prosecuted.
BE IT FURTHER RESOLVED that the portion of Ochiro Road, highlighted on
Exhibits "B" and "C," is abandoned pursuant to Sections 2-111 and 2-118, Hawaii County
Code, and the finance director is hereby authorized to dispose of the Ochiro Road remnant
without recourse to public auction in the manner set forth in Hawaii County Code Section
2-118, to Jack Ramos Ranch, Inc., the abutting owner.
BE IT FURTHER RESOLVED that the Clerk of the County of Hawaii is directed to
transmit copies of this resolution to (1) Jack Ramos Ranch, Inc., c/o Alan M. Okamoto, Esq.,
Nakamoto, Yoshioka & Okamoto, 187 Kapi`olani Street, Hilo, Hawaii 96720; (2) the Honorable
Stephen K. Yamashiro, Mayor of the County of Hawaii; (3) the Finance Director; (4) the
Department of Public Works; and (5) the Office of the Corporation Counsel.
