HomeMy WebLinkAboutRES 214 Draft 01 1998-2000 COUNTY OF HAWAII STATE OF HAWAII RESOLUTION N0. a 14 ~?(1 RESOLUTION AUTHORIZING THE GRANT OF EASEMENT FOR WATERLINE AND SEWER EASEMENT AT KAPALAALAEA 2d (Beach Section), DISTRICT OF NORTH KONA, ISLAND, COUNTY AND STATE OF HAWAII, TAX MAP KEY NO. (3) 7-7-10: VICINITY OF 6 AND 76, TO ROBERT C. ROBERTSON. WHEREAS, the County of Hawaii is the owner of that certain abandoned government road parcel located between Tax Map Key Nos. (3) 7-7-10:06 and 76, located at Kapalaalaea 2d, District of North Kona, Island, County and State of Hawaii, being more particularly delineated on Exhibit "A"(description and map), said exhibit prepared by Wes Thomas and Associates; and WHEREAS, Mr. ROBERT C. ROBERTSON needs the grant of easement to construct, reconstruct, repair, maintain and operate a water service line and a sewer or cesspool line, and to use such appliances and equipment as may be necessary for the transmission and distribution of water and the transmission of wastewater and/or sewage, over, under, upon, across and through said abandoned government road; and WHEREAS, Section 2-111 of the Hawaii County Code requires that the Council, by resolution, authorize the Grant of Easement from the County of Hawaii, subject, however, to reversion to the County of Hawaii upon termination or abandonment of the easement for the specific purposes for which it was granted; and WHEREAS, the subject easement area has been appraised by a certified general appraiser at a value of $700.00, which Mr. Robertson has agreed to pay the County of Hawaii for the easement. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in accordance with Section 2-111 of the Hawaii County Code, that the County of Hawaii authorizes a grant of easement for the construction, reconstruction, repair, maintenance and operation of a water service line and a sewer or cesspool line, and to use such appliances and equipment as may be necessary for the transmission and distribution of water and the transmission of wastewater and/or sewage, as delineated in the description and map submitted by Wes Thomas and Associates, attached hereto, over the described portion of the abandoned government road, until termination of those specific purposes, to Robert C.
