RESOLUTION N0. `'20 (70
RESOLUTION AUTHORIZING THE COUNTY OF HAWAII LOCAL EMERGENCY
PLANNING COMMITTEE (LEPC) TO ENTER INTO AN AGREEMENT WITH THE
HAWAII STATE EMERGENCY RESPONSE COMMISSION (HSERC) TO ACCEPT
FUNDING FROM THE HSERC AND DISBURSE SUCH FUNDS.
WHEREAS, Chapter 128E of the Hawaii Revised Statutes establishes the Hawaii
State Emergency Response Commission (HSERC) whose functions are set out in HRS
§ 128E-2(g) and include planning for and setting policy regarding potential problems
involved with hazardous materials; and
WHEREAS, pursuant to HRS § 128E-5, the County of Hawaii has established a
Local Emergency Planning Committee (LEPC) to work with the HSERC to deal with
such environmental problems; and
WHEREAS, the Hawaii State Emergency Response Commission has made
available to each county Local Emergency Planning Committee annual funding under the
Hawaii Emergency Planning and Community Right-to-Know Act and other federal grant
programs for hazardous materials emergency planning and preparedness purposes; and
WHEREAS, the Hawaii County Local Emergency Planning Committee wishes to
accept funds from the HSERC to improve and enhance hazardous materials emergency
management planning and preparedness capabilities; and
WHEREAS, pursuant to HRS §46-7 county departments must obtain the consent
of the council to enter into agreements with the federal or state governments respecting
the action to be taken pursuant to any of the powers granted by law to furnish, expend and
receive any funds or other assistance in connection with the projects being or to be
undertaken pursuant to those powers;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
COUNTY OF HAWAII that the Office of the Mayor is authorized to enter into an
agreement with the Hawaii State Emergency Response Commission to accept and
disburse funds from the HSERC to be used for the appropriate purposes of the Local
Emergency Planning Committee.
BE IT FURTHER RESOLVED that the Mayor of the County of Hawaii is
authorized to sign the referenced agreement and any related documents on behalf of the
County of Hawaii pursuant to the Hawaii County Charter, Article V, Section 5-1.3(g).

BE IT FURTHER RESOLVED that the County Clerk of the County of Hawaii
shall transmit copies of this Resolution to the Finance Department and the Fire
Department.
