Ashida Corporation Counsel County of Hawaii 333 Kilauea Avenue, Second.Floor Hilo, Hawaii 96720 Dear Mr. Ashida: This responds to your July 25, 2013 email and attached letter requesting that the Attorney General advise the County of Hawaii on the constitutionality of Hawai' i County Council Bill 79 which seeks to make unlawful the "propagation, cultivation, raising, growing, sale or distribution of transgenic organism" within the County of Hawaii. As you aft probably already aware, the State of Hawaii currently has no statute regulating the "propagation, cultivation, raising, growing, sale or distribution" of transgenic organisms (genetically modified organisms, or "GMOs "). Applicants to any federal agency for a permit or approval of any "bioproduct, field testing of genetically modified organisms, or environmental impact assessment of genetically modified organisms" are required to provide the Department of Health a copy of that application pursuant to Hawaii Revised Statutes (HRS) § 321 -11.6. This is, however, a simple notification requirement and, therefore, your question involves an analysis only of the likelihood that Bill 79 will be federally preempted.
