STATE OF HAWAII 38 15 RESOLUTION ACCEPTING THE DEDICATION OF ROAD LOT 33 (KAMANU STREET STUB-OUT/EXTENSION), ROAD LOT 34 (KAIAKOILI STREET), ROAD LOT 35 (MAIAU STREET), ROAD LOT 36 (KAUHOLA STREET), ROAD LOT 37 (OLOWALU STREET) AND ROAD LOT 38 (KAMANU STREET WIDENING) TAX MAP KEYS: (3) 7-3-051:131, 132, 133, 134, 135 AND 136, OF THE KALOKO LIGHT INDUSTRIAL SUBDIVISION, PHASE III, BEING ALSO A PORTION OF R.P. 8214, L.C. Aw. 7715, APANA 11 TO LOT A KAMEHAMEHA, SITUATE AT KALOKO, DISTRICT OF NORTH KONA, ISLAND OF HAWAII, STATE OF HAWAII, FROM TSA, LLC. WHEREAS, TSA, LLC, is the owner of Road Lot 33 Kamanu Street Stub-out/Extension 0.560 acre Road Lot 34 Kaiakoili Street 0.852 acre Road Lot 35 Maiau Street 0.825 acre Road Lot 36 Kauhola Street 0.823 acre Road Lot 37 Olowalu Street 0.998 acre Road Lot 38 Kamanu Street 0.249 acre identified as Tax Map Key Nos: (3) 7-3-051:131, 132, 133, 134, 135 and 136 situate at Kaloko, District of North Kona, Island of Hawaii, State of Hawaii, as delineated on Exhibit "A" attached; and WHEREAS, TSA, LLC, has constructed all subdivision improvements and received final subdivision approval for the above referenced lot; and WHEREAS, TSA, LLC, is desirous of dedicating the above roadway lot, including all subdivision improvements thereon, to the County of Hawaii for roadway purposes, and the improvements have been inspected and approved by the County of Hawaii Department of Public Works, and received dedication approval from the Department of Water Supply, Planning Department and Department of Environmental Management; and WHEREAS, Section 23-10 of the Hawaii County Code prohibits the Council from receiving by dedication any streets in any subdivision platted after December 2, 1966, except upon full compliance with the provisions of Chapter 23; and WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter, provides that the council may accept gifts, which include the dedication of land, on behalf of the County of Hawaii BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that it finds the subject subdivision and improvements thereon are in full compliance with the provisions of Chapter 23 of the Hawaii County Code as certified and approved by all applicable agencies. BE IT FURTHER RESOLVED, in accordance with Article XIII, Section 13-12 of the Hawaii County Charter, and Section 23-10 of the Hawaii County Code, that the County of Hawaii accepts the dedication of Road Lot 33 (Kamanu Street stub-out/extension), containing an area of approximately 0.560 acre; Road Lot 34 (Kaiakoili Street), containing an area of approximately 0.852 acre; Road Lot 35 (Maiau Street), containing an area of approximately 0.825 acre; Road Lot 36 (Kauhola Street), containing an area of approximately 0.823 acre; Road Lot 37 (Olowalu Street) containing an area of approximately 0.998 acre; and Road Lot 38 (Kamanu Street widening), containing an area of approximately 0.249 acre, more or less, identified as Tax Map Keys: (3) 7-3- 051:131, 132, 133, 134, 135 and 136, delineated on Exhibit "A" attached hereto, including all improvements thereon, for public road purposes. BE IT FINALLY RESOLVED that a copy of this resolution be forwarded to: (1) Mayor William P. Kenoi; (2) the Department of Public Works; (3) Deputy Corporation Counsel Katherine A.
