RESOLUTION AUTHORIZING THE SALE, IN FEE SIMPLE, OF LOT 6 OF
"CROSSROADS" SITUATE AT LANIHAU ls`, NORTH KONA, HAWAII.
BE [T RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII:
WHEREAS, the County of Hawaii is the owner of that certain parcel of land,
being Lot 6 of "Crossroads," situate at Lanihau 1 s`, North Kona, Hawaii, further
identified as Tax Map Key: 3`d/7-5-04:63; and
WHEREAS, Lot 6 is roughly triangular in shape and contains an area of
43,562 syuare feet, more or less (Exhibit "A"); and
WHEREAS, the County of Hawaii does not have plans to utilize Lot 6 for any of
its programs; and
WHEREAS, the County of Hawaii has received an offer from the Maryl Group,
Inc. (Exhibit "B") to purchase in fee simple or to lease with an option to purchase, Lot 6
of "Crossroads;" and
WHEREAS, the County of Hawaii has submitted to the Office of Environmental
Quality Control, a Final Environmental Assessment for the disposition and subsequent
commercial development of Lot 6 of "Crossroads" and has issued a Findings of No
Significant Impact (FONSI); and
WHEREAS, Section 2-111, Powers of Council, Hawaii County Code, provides,
in part, that the Council may, by resolution approved by a majority of its members, direct
the Finance Director to dispose of real property in fee simple; and
WHEREAS, on June 19, 1998, the Council adopted Resolution No. 279-98,
requesting the mayor to negotiate with SoBay Hawaii, Inc., to acquire the beachfront
parcel at Wai`aha, North Kona, Hawaii, identified by TMK: 7-5-18:20 for public
purposes; and
WHEREAS, on March 22, 2000, the Council adopted Bill 198, which amended
the Capital Budget in order to acquire the Wai`aha Bay property identified as
TMK: 7-5-18:20.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
COUNTY OF HAWAII through its authority under Section 2-111, Hawaii County
Code, that the Finance Director is authorized to sell, at public action, in fee simple, Lot 6
of "Crossroads," further identified as Tax Map Key: 3` /7-t-04:63 in a manner consistent
with the applicable sections of Chapter 2, Article 19, Real Property Disposition, Hawaii
County Code.
BE IT FURTHER RESOLVED that the proceeds derived from the sale of the
subject property (TMK: 7-5-04:63) shall be used solely for projects in the North Kona
district, with first priority given to the acquisition of lands of Wai`aha, per Ordinance
No. 00-36 (Bill l98), unless otherwise directed by the Council.
BE IT FURTHER RESOLVED that the County Clerk shall transmit a copy of this
resolution to the Honorable Stephen K. Yamashiro, Mayor of the County of Hawaii,
Harry A. Takahashi, Director of Finance, and Mark S. Richards, President of Maryl
Group,lnc.
