Ordinance 13 -121
Dear Council member,
I urge you to OPPOSE Resolution 22 -14 and any motion to appeal U.S. Magistrate Judge Barry Kurren's decision to
invalidate Hawai'i County Ordinance 13 -121.
The U.S. Magistrate's decision invalidated the ordinance because it "is preempted by Hawaii state law ", "is, in part,
expressly preempted by the federal Plant Protection Act ", and "therefore ... is invalid.
It appears to me the appealing the ruling will not be successful, and will mean county resources and money will be
wasted.
