Your Committee on Planning, to which was referred Res. No. 41-15, reports as follows:
Resolution No. 41-15, transmitted by Planning Director Duane Kanuha via Communication 65
dated December 26, 2014, authorizes approval of in lieu fair share contribution to satisfy
condition "M" of Ordinance No. 09-149. Resolution 41-15 approves the in lieu actual cost of
contribution of land in the amount of $2,400 to offset the full amount of the fair share
contribution as required in Condition "M" of the Ordinance.
Ordinance No. 09-149 (herein after referred to as "the Ordinance"), effective December 3, 2009,
changed the zoning district classification from Agricultural (A -3a) to Family Agricultural
(FA -la) for the 5.50 acre parcel at Waiakea, South Hilo, covered by Tax Map Key (3)
2-4-031:008 (hereinafter referred to as "the Property.") Condition "M" of the Ordinance requires
payment of $11,996.63 per single family residence. Edwin Y. Nagata Trust, the landowner of the
Property, has developed four single family residential lots and has contributed $35,989.89 in fair
share payments. The Edwin Y. Nagata Trust has requested to provide a portion of the fair share
requirement for Parks and Recreation, Police, Fire, and Solid Waste Facilities and Road and
Traffic Improvements, $2,400, to be in the form of in lieu credit for the contribution of land as
required by Condition "F" of the Ordinance. The estimated market value of the subject land is
$2,400. Condition "M" of the Ordinance states that the cost of contributing land required in
Condition "F" shall be credited against the sum specified in Condition "M."
Your Committee on Planning is in accord with the purpose and intent of Res. No. 41-15 and
recommends its adoption.
