Tal 808.943.1133 Fax 808.947.8225 July 20,1999 Ms. Virginia Goldstein, Planning Director Planning Department, County of Hawaii 25 Aupuni Street Hilo, Hawaii 96720 Subject: Change of Zone Condition F, "Comply with Applicable Depaztment of Health Noise and Emission Control;' for Hawaii Electric Light Company, Inc.'s (HELCO's) Puna Generating Staiion, TMK 1-06-03:93 Dear Ms. Goldstein: Condition F of Ordinance 99-53 which rezoned HELCO's Puna Generating Station, TMK 1-06-03:93, states: The applicant shall comply with applicable Department of Health regulations for noise and emission control. Hawaii Administrative Rule (HAR), Title 11, Chapter 46 Community Noise Control, was adopted by the State Department of Health (DOH) in September 1996. The DOH noise regulations are expressed in maximum permissible sound levels within areas zoned preservation/residential, apartment/commercial, and agricultural/industrial. Since the HELCO Puna Generating Sta- tion's site is zoned industrial and the adjoining sites have agricultural zoning designations, the applicable DOH noise standards are 70 dBA for both the daytime and nighttime periods. As substantiated by the following information, HELCO's Puna Generating Station has com- pliedwith applicable Department of Health requirements related to noise, and has satisfied change of zone condition F of Ordinance 99-53: 1. The Puna Generating Station has not been cited for any violation of HAR 116, Community Noise Control, nor has it had any noise related complaints. 2. In June 1999, HELCO conducted noise measurements at the Puna Generating Station. The noise measurements indicated that the Generating Station is not exceeding the 70-dBA noise level at any point along the station's property line. Based on the aforementioned noise measurements, HELCO is currently complying with the noise and emission standards set forth in HAR, Title 11, Chapter 46.
