This is to acknowledge receipt of your October 12, 1999 letter informing us of the Keaau Road
improvements as required by Condition D of the above-referenced ordinance. Based on the
above, compliance with Condition D of Ordinance No. 99-53 has been met.
As mentioned all applicable conditions of Ordinance No. 99-54 have been satis£ed by the
applicant. Therefore, no further reports are required. Thank you for complying with all
conditions of the Ordinance.

Status Report; 'for Hawaii Electric Light Company, Ines (HELCO's) Puna
Generating Station, TMK 1-06-03:93, Ordinance 99-53
Dear Virginia:
Condition "D " "Keaau Road Improvements"
Condition "D; ' "Keaau Road Improvements," of the rezoning for HELCO's Puna Generating
Station, TMK 1-06-03:93, Ordinance 99-53, states:
Keaau Road (TMK 1-6-03: Portion of 73) and TMK: 1-6-03 Portion of 15 shall be paved to
a width of 20 feet from its intersection with the Old Volcano Road to the entrance gate of
the subject property within one year of the completion of the Keaau By-Pass Road
meeting with the approval of W. H. Shipman, Ltd. and the Department of
Transportation. These roadway easements may be paved in conjunction with roadway
improvements for the Keaau By-Pass Road.
The referenced improvements to Keaau Road were completed by the contractor for the Keaau
By-Pass Road in conjunction with the phase two work for the project. The By-Pass Road and
the aforementioned improvements were part of a State Department of Transportation project,
and were approved by the State Department of Transportation. The improvements to the
portions of Keaau Road referenced in condition "D" are on a roadway owned by W. H.
Shipman, Ltd., and these improvements were approved by W. H. Shipman, Ltd.
In light of the foregoing, condition "D" of HELCO's Puna Generating Station, TMK 1-06-03:93,
Ordinance 99-53, has been satisfied.

Condition "I," "Final Status Report"
Condition "I;' "Final Status Report;' of the rezoning for HELCO's Puna Generating Station,
TMKl-06-03:93, Ordinance 99-53, states:
Upon compliance with applicable conditions of approval, the applicant shall submit a
final status report, in writing, to the Planning Director.
The applicable conditions of approval subject to being satisfied prior to submittal of this final
status report are conditions "A" through "H" of Ordinance 99-53. The satisfaction of condition
"D" is addressed in this letter. The satisfaction of conditions "A" through "C" and "E" through
"H" have been acknowledged in prior correspondence from the Planning Department.
Subject to your concurrence that condition "D" has been satisfied, we are submitting this status
report regarding conditions "A" through "H" to satisfy condition "I" of HELCO's Puna
Generating Station, TMK 1-06-03:93, Ordinance 99-53.
If you concur, please acknowledge satisfaction of conditions "D" and "I". Should you have any
